1. Introduction

Unless otherwise indicated, the apps are the property of Silessian Software . The software and services provided by Silessian Software  are at all times subject to these termsand conditions. By using any of our apps you confirm your acceptance of, and agreeto be bound by, these term and conditions. These terms and conditions shall constitute the agreement between you and Silessian Software  ("this Agreement").

2. Agreement to Terms and Conditions

This Agreement takes effect on the date on which you install one of Silessian Software’ appinto any Atlassian cloud site.

3. Payment and License Duration

You agree to pay the applicable Fees in advance directly to Atlassian as required toenable you and your Authorised Users to access and use the Software. Payment of such fees will be in accordance with the applicable Atlassian Terms. Silessian Software pricing structure or payment methods may be amended from time to time at its solediscretion. In case of you breaking any part of this license, you lose all rights under the license.

4. Disclaimer

Silessian Software does not guarantee that any software provided will meet your requirements or that it will operate without interruptions or errors. Silessian Software excludes and explicitly disclaims all express and implied warranties or conditions not stated in this Agreement (including, but not limited to, loss of profits, loss or corruption of data, business interruptions, or loss of contracts), to the extent permitted by applicable law. This Agreement does not affect your statutory rights.

5. Notices and Consents

Any notice, request, or other communication between the parties under this Agreement shall be made via email.

6. General Terms and Law

This Agreement is governed by Polish law. You acknowledge that your use of these services does not create any joint venture, partnership, employment, or agency relationship between you and Silessian Software.
You agree not to present yourself as a representative, agent, or employee of Silessian Software.
You also agree that Silessian Software will not be held liable for any representations, actions, or omissions on your part.Silessian Software’s obligations under this Agreement are always subject to existing laws and legal processes.
Nothing in this Agreement limits Silessian Software's right to comply with law enforcement requests or requirements related to your use of Silessian Software or information provided to or collected by Silessian Software in connection with such use.

7. Use of Customer Endorsements, Logos for Marketing Purposes

Silessian Software reserves the right to publicly use the customer's name, logo, and any testimonials provided by the customer regarding our software for advertising and promotional purposes, unless the customer objects. The customer grants Silessian Software the necessary rights related to copyrights, naming, trademarks, and branding for these purposes.

8. Severability

If any provision of this Agreement is found to be illegal or unenforceable, the remaining provisions shall continue in full force and effect, and the validity of the rest will not be affected (unless the core purpose of this Agreement is compromised, in which case either party may terminate this Agreement immediately with written notice).

9. Entire Agreement

This Agreement constitutes the entire agreement between you and Silessian Software regarding your use of the services, software, and/or goods provided by Silessian Software, and it supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Silessian Software on this matter.
Each party confirms that it has not relied on any representation not documented in this Agreement as an inducement to enter into it.
